Signs You Might Need Help From A Tax Attorney

Earlier in the week my law firm’s Tax Relief Blog posted a helpful article on the signs that you might need help from a tax attorney. Listed below are a few of the signs, but you can find the full article here.

1. You Cannot Remember The Last Time You Filed A Tax Return

If you are earning income and have not filed a tax return for a few years, then you might want to consider hiring a tax attorney. Even if you do not think that you owe the IRS money, a tax attorney can provide you with a full review of your IRS account to determine if you are owed any refunds.

2. You Get An Assessment Letter From The IRS

If you receive an assessment letter in the mail from the IRS, then it means they have determined that you owe them money. The first letter they send informs you of the situation and outlines the penalties and interest they are adding to your debt. If you do nothing, your debt will continue to increase. Alternatively, if you retain a tax attorney, they can begin working to settle your debts.

3. The IRS Files A Lien Against Your Property

If the IRS assesses a tax debt against you and you do not respond, then they will begin the collection process. First, they may send you a Notice and Demand for Payment. If you do not respond after 10 days, then they can file a public Federal Tax Lien against you. The lien will attach itself to all of your property including homes, land, vehicles, etc. In order to get the lien released, you will need to first settle your IRS debts. This can be done by either paying the amount in full or hiring an attorney to negotiate an IRS settlement such as an Offer in Compromise.

Tax Attorney Pans IRS OIC Program

A few weeks ago I sent an open letter to the IRS regarding their Offer in Compromise (OIC) program. It recently came to my attention that WebCPA, a site with tools and news for accountants, had posted an article about my open letter. Below is the text from their article.

Tax attorney Roni Deutch has written an open letter to the Internal Revenue Service criticizing the agency's offer in compromise program, which is supposed to help taxpayers settle their debts.

The letter came in response to a recent questionnaire from the IRS asking recipients how satisfied they were with the program. Deutch described several objections that she and other attorneys at her firm share. The firm has been helping taxpayers settle their debts with the IRS for 17 years.

Deutch noted that she had sent a similar list of suggested improvements in December 2005, the last time the IRS sent out a questionnaire to taxpayers and tax professionals about the OIC program, but the IRS essentially ignored them.

"In those three years, the IRS has done nothing to act upon our requests," wrote Deutch. "Thus, I resubmit these requests to you for consideration and action."

One of her criticisms is that the IRS is not doing an adequate review of its Effective Tax Administration offers in compromise. "There are not enough sufficiently trained employees at the IRS to review and accept ETA OICs," she wrote. "When an ETA OIC is filed, the taxpayer states that 'I owe this amount and have sufficient assets to pay the full amount, but due to my exceptional circumstances, requiring full payment would cause an economic hardship or would be unfair and inequitable.'"

Arkansas Attorney Mishandles IRS Payments and Amended Returns

Hired to amend a return and submit the balance due, the Bentonville, Arkansas attorney asked that IRS payment be made out to him and he would forward the money. Rather than paying the IRS, the attorney cashed and spent the proceeds, and failed to file the amended return.The suit alleges legal malpractice, breach of fiduciary duty, and conversion.
